Lawyers for Wall Street investment banks say it is a highly technical matter where the line is drawn between legal and illegal activity in the sale of newly issued stock. It must be left to highly trained securities regulators to decide, rather than to courtroom juries in antitrust lawsuits brought by investors, the industry says.

There's only one thing that I need to read:
Shares of Gotyomoneyb*otchinc are not deposits or obligations of any bank, are not guaranteed by any bank, are not insured by the FDIC or any other agency, and involve investment risks, including the possible loss of the principal amount invested.

Yeah yeah yeah, cut losses to 7%....and fancy anagrams don't impress me...It's palabra. What happens when you lose 30% in a day in a stock? We'll find out as velocity increases more...and more...and more...and more....It's inevitable with wealth being centralized...
Speaking of shenanigans with stocks...You should see the fiasco I've had to go through in order to rollover my wife's 401k to an IRA....We still haven't got the check...I'm talking 4 months now..."It's in the mail"....Call after call after call after call...Maybe today is the day...I know they're going to f*ck up the 1099...It's almost a given. If these stock whores are so f*cking cheap that they can't take the time and effort to hire someone with a brain, how the f*ck do they expect me to trust them with my money?

Financial "services" companies piss me off when they play that game. I've been through a couple of nightmare deals when they didn't want to let go of money for a transfer.
But regarding stocks, you concentrate far too much on losses. There are defensive ways to invest in stocks that lower your risk while increasing returns.

This is one reason I'm damn sure the turnip will have nothing when the going gets tough....This isn't an employee thing...This is a direct "hold them off at all costs, we can't give it back to them until the quarterly" thing....Unfortunately...That game will run out.
Defensive, you say? Shall we bet a dollar on this one, Randolph? I say they can put a defensive trader in the poorhouse while getting rich at the same time...Whattaya say?

I missed this post and apologize for doing so. BTW, I didn't make any trades today. I had to go to the airport to pick up my niece and got to work late.
Anyway, you've probably heard all kinds of horror stories about derivatives and how you can lose so much money. Those stories are absolutely true, but there are defensive strategies that allow you to make steady money defensively using derivatives.
Think of how many get-rich-quick suckers there are in the world. The fastest way there is to get rich in the stock market is to buy naked options. 80% of options expire worthless, but there is sometimes a big score. The idea is to make money STEADILY from those get-rich-quick suckers. You guy a stock that you believe will make you money. You sell call options a month out at a time and sell strikes that will make you money while you lower your effective cost basis. You limit your upside, but in the long term you can generate a lot of steady cash.

Straight option plays are zero sum, but that's not what I'm talking about. You have to work through a few real life examples to see how call writing works. I'll post some numbers and examples when I get more time.

Stocks are an enigma to me....I have good friends that daytrade and they are more than 100% correct in saying that just because you are an accountant that doesn't mean you know sh*t about the market....It's true...But honestly, I'm glad I don't....Too many clients try to milk me for the next great move...then I tell them I don't know jack. I have difficulty watching Cramer. His show isn't my cup of tea. He is a successful stock picker, but I just don't care for his style.
In the big selloff a few years ago, those who followed his advice made big money. When a lot of folks were bargain hunting (or catching a falling knife as my buddy Bill O'Neill calls it), Cramer told people not to buy any stock whose products you can't buy in a grocery store.

Indeed, Cramer is a very, very knowledgable man....But once the secret is out, there is no more secret. His chips are all in the entertainment biz now...Substance is dead. Quintessential sellout. But hey, can ya blame him? Of course, unlike your story from the tech disaster, now his face will be the face of the sheeple masses falling off the cliff, rather than a light of hope more often than not.

The futures are looking quite fine today. We should have some nice volatility, which should make for at least a couple easy option plays.

I thought her hubby was all about defense spending cuts...

Its all good. I bought my house while Credit was still available. I still have my credit cards too.
The kids growing up will not have credit opportunities available to them from banks. I'll be the one with all the purchasing/lending power. I'll then offer my purchasing/borrowing power on to the secondary markets and become even more wealthy.
This will allow the rich to get richer as banks are unwilling to lend, rich individuals and Cash Now places will reap the benefit.

In the new economy borrowing money will be much tougher. So, college grad making $50K wants to go buy a house. Banks says NO! Same guy wants a credit card. Bank says no.
Mike already has credit and cash available to lend. When the banks say no, Mike says yes! (but at a nice interest point). Mike lends Joe a LOC at 30%. Mike only is paying 15% for that money. Mike makes 15%. Good return for Mike. Mike also rents his home out and since the rental market is so tight since nobody can buy, makes a killing.
Mike has the borrowing power and money. So, Mike gets richer, while Joe gets poorer.

I don't like the elimination of the uptick rule, but there were ways around it especially using options. Elimination of the rule won't really change anything since stock prices are determined by fundamentals and not merely by traders.
44 points isn't so much that I'd say the bulls are back. We need to see a couple of days of accumulation.

Over 75% of stocks are held by institutional investors. I don't believe any of that is leveraged. If all of the remaining 25% was on margin, that would leave 12 1/2% at max. It can't be that high as a good amount of those holdings are in qualified plans where margin trading is not allowed. I don't know what that percentage is. I'd guess it's closer to a total of around 8%.

I showed you the chart. Right back to zero (bout 10k) from the housing debacle around early 2005....You could argue inflation and growth (snickers) since then might mean slightly less than that, but I would argue that downward momentum will blow that away...The herd will overshoot the target...It always does...So I just call it a wash and look to 10k....
It's all fraud man. I do the books. It's all fraud. Everyone's bailing. The days where I had random f*cking people come into the office looking for an accountant's letter so they could rip the bank off a couple hundred grand are over. (We never did that...but they would come right in and ask us anyway...'twas quite the conversation: "I need a letter from an accountant saying I've been self-employed for the last two year. Well, have you? Where are your tax returns? No...I didn't work...I haven't filed. I just need the letter. Ummm...That's fraud? No it isn't. The bank told me to come ask themselves.")
Just like I told my Uncle last week...."You know those f*cking guys you, as a hard working son of a gun, ask yourself about over and over "How does he do it?" and it just defies logic but you can't put your finger on it....The answer to that is: They aren't making it and it does defy logic.

Joe Sixpack Is Likely Savior Of Wall Street
http://ibdeditorials.com/IBDArticles.aspx?id=271893934246377
The Wall Street brainiacs are panicked about sub-prime mortgages and the current stock-market correction. But Main Street investors — with their plentiful incomes and longer-term stock market horizons — ultimately may bail them out.
Main Street rescuing Wall Street? It's a compelling thought — not only for the stock market, but the economy at-large.
While Wall Street was busy conjuring up high-yielding bond packages that were heavily invested in unsustainable sub-prime mortgages — and distributing these collateralized debt obligations to big institutional investors around the world — Main Street was focused on the real economics of our nation.
To this day, the American labor force is going to work, running the millions of small owner-operated companies that provide the wellspring of our prosperity.
Main Street is benefiting from an unprecedented global boom that is stocking our stores with affordable goods and creating plentiful new jobs as U.S. firms service the rise of new export markets.
With a record 146 million men and women working, and the unemployment rate at a historically low 4.6%, the American labor force has increased its after-tax real income by a whopping $257 billion.
Nominal wages for non-supervisory workers alone have sprouted by $296 billion over the past year, according to Wall Street economist David Malpass. Average compensation per hour has grown 5.2%.
According to economist Joe LaVorgna, these high-income trends continue right to the present day. His tracking of employee tax withholding receipts collected daily by the U.S. Treasury shows 6% to 7% gains through early August.
All of this suggests that when adjustable rate mortgages are reset in the coming months and years, our large working population has the resources to handle it.
The pattern is the same for American business. After-tax corporate profits have grown $578 billion to $1.1 trillion over the past five years, which is why jobs, the economy and the stock market have performed so well. Very simply, profitable businesses are creating the jobs that are providing the incomes for families to spend. It's an enduring story: Second-quarter profits for S&P 500 companies increased more than twice what Wall Street expected.
Meanwhile, the Federal Reserve reports that businesses don't even need new loans.
Corporate cash flow is so strong that firms are generating $987 billion in funds internally, which actually is more than the $973 billion they are investing in new plants, equipment and office buildings.
Bottom line: While the sub-prime mortgage virus has temporarily infected banks, hedge funds, insurance companies and other institutions, most of Middle America is doing just fine, thank you very much.
Sheila Bair, the very smart chair of the Federal Deposit Insurance Corporation, told me in an interview that 85% of the outstanding sub-prime mortgages at her member banks are being serviced on time.
She also reports that the banking system is highly profitable and that capital adequacy is oversubscribed. Others report that less than 1% of the entire mortgage total in this country is in default, a minuscule amount.
The biggest problem in the stock market is that the sub-prime virus has caused a temporary credit and trading freeze. Markets already have devalued mortgage bond prices, but the banks are loath to acknowledge price drops that would mean sizable third-quarter profit losses.
This is silly and shortsighted. Countrywide, for example, the nation's largest mortgage lender, has seen its stock drop by 40%; Bear Stearns has fallen 35%.
The sooner financial companies liquidate their losses, the faster markets will return to normalcy. The system is de-leveraging, which in the long-term is a very healthy correction. Leveraged corporate loans actually are starting to trade-up once again, undoubtedly reflecting the money-good profits behind them.
Federal Reserve officials believe we have a temporary liquidity issue, not a solvency crisis. So, at the prevailing interest-rate target, the Fed and other central banks are prudently injecting $131 billion of new cash to "facilitate the orderly functioning" of markets.
Fed Chairman Ben Bernanke has it right.
So does President Bush, who is arguing against government bailouts, which would wind up rewarding banks, hedge funds and unscrupulous lenders for their poor judgment. (Do U.S. taxpayers really want to finance France's BNP Paribas?)
Market forces will see us through this correction. Bush also is on the money with his opposition to any and all tax increases, which would damage the work and business incentives that have been such a success in Middle America.
Nobody likes stiff stock market corrections. But if folks step back a bit they will see the many positives — the jobs, the incomes, and the profits — that will carry us through this difficult period.
They will see Main Street — working and prospering.

Smoke and mirrors m'boy...#1, the fed's actions speak louder than words...I see a 6 billion drain and a 5.35% out there thus far...and #2, if the fed's discount window is opened, what does that tell real investors about the current state of the market?

The tech drop had to happen as too many stocks were overbought. Companies with no hope of making profit were selling for crazy amounts of money. Whatever the fed did or didn't do wasn't going to "help" the tech sell off.

Start out by looking at historical charts. Look for definite patterns of reversals and such. When you are comfortable that you have a winning strategy, you wait for the same conditions to happen again. When they do, you're ready to make a trade.

LOL That's one of the funniest posts ever.
But you're missing the point. I very rarely give stock tips. I advocate doing your own research. Nobody cares more about my money than I do. Nobody will care more about your money than you do.

How about we skip dinner and go halves on a late night informercial...You can be the star and tout stock trading and my head will pop up in a bubble in the corner of the screen every now and then with something witty like "You f*cking idiot...Go to bed before you lose all your f*cking money" or "You really believe this sh*t? Enjoy the dog food in retirement."...Then you can keep on trucking like nothing happened with the stock touting...
We could be selling one of those "choose your own adventure books" but for speculating..."Go to page 69 if you want to buy the house with zero down on negative amortization"..."Go to page 123 if you would like to save your pennies for a 20% downpayment and fixed mortgage"
On page 69, we could put a picture of a hooker with some champagne followed by "Now proceed directly to page 999" and then we can put a picture of a bankruptcy attorney and a "Congratulations, you get to read again...Please return to page 1"
On page 123, we can put "Oh, I'm sorry, you died of a terminal disease while saving and will never experience home ownership...Have a nice day."
